Terms and Conditions
Price Basis: All prices are Ex – Works (KHALAPUR, Maharashtra, India. All discounts and special prices are specific to orders which are contracted for specific projects with prior approval from Hydrolift. The prices do not include Taxes, Duties, Cess or any other charges levied by the government from time to time and subject to changes without notice. Quotation from Hydrolift is not binding till such time the quote is converted to an order mutually agreed between Hydrolift and the customer.
Packing & Forwarding: There will be an extra charge of 4% for packing and forwarding OR NILLif collected from our factory in unpack condition. Packing charges will not be applicable in case of installation of the equipment on the vehicle.
Freight & Transport: All charges on account of Freight/Transportation will be charged to Buyer’s Account or on Freight toPay basis.
Insurance: The transit insurance for the consignment on leaving the factory must be covered by the Buyer.
Payment Terms: 50% Advance along with the order and 50% Balance payment including taxes to be settled in full prior todispatch / deliveryor collection of material.
Payment shall be made to our account directly. In case of payment by letter of credit, all bank charges shall be borne by the customer.
In case of part payment, delay in settling the part payment will incur interest of 8% per annum on pro-rata basis. Any charges incurred for sending reminders, courier charges, postal charges, travel, etc. or the like in recovery of payment will be charged to the customer on actual + 10% administrative charges.
In the event the balance payment be delayed after conveying the readiness of materials, if the materials are not taken delivery within 21 days from such intimation, Hydrolift reserves the right to dispose of the material and no further claims will be entertained thereafter. The transfer of ownership of the material to the customer will take place on receipt of the payment in full by Hydrolift, till such time, the ownership will be with Hydrolift.
Delivery Period: If ex-stock within 4 weeks from receipt of confirmed order and payment into our account. Manufacturing time12-14 weeks, from date of receipt of confirmed order and advance payment.Availability of stocksare subject to prior sales.
In case of installation or fitment on the vehicle at the factory, the specifications, drawings, information and details shall be provided at least 4 weeks prior to the start of installation. Any delays in receiving such information, will not bind Hydrolift for adhering to the final deliveries.
On completion of the production, Hydrolift shall inform the customer of the readiness of the material and to arrange the transportation for shipment of the materials. Till such time the customer arranges the transportation and taking delivery, Hydrolift shall store the materials in their warehouse with due care, but at the risk and expense of the customer.
In case of force majeure, like fire, earthquake, floods, tsunami, strikes, work stoppages, disruption of works, transportation issues, Hydrolift reserves the right to withdrew from the contractual obligation without accepting any further claims or damages on account of such delays. Hydrolift may provide the delivery within a mutually agreed period after such disruption of work ends.
Any liability for consequential damages due to delay shall be excluded provided such delivery does not exceed 12 weeks from the agreed delivery date. In the event of gross negligence or intent if the delay exceeds 12 weeks, the liability of delays shall be capped to a maximum of 5% of the order value and Hydrolift shall be excluded from any consequential damages.
Validity: Allprices quoted are valid for 30 days from the date of offer. Extension of validity, if required must be obtained prior to order placement.
Inspection: Prior information will be given to the customer upon the readiness of material for inspecting and testing. Any charges or cost of Inspection in house or third party must be borne by the Buyer
Additional Certificate: All Products are individually tested, and manufactured as per HYDROLIFT standard, any additional Test / Inspection certificate if required is to be specifically mentioned in your purchase order& will be charged at an extra cost.
Warranty: The above Hydraulic cranes are warranted for 12 months from the date of our Invoice. (please refer the warranty terms)
Taxes: All taxes as applicable at the time of invoicing will be charged and to be paid prior to the shipment of the material.
Others: All the standard terms and conditions stated above are valid unless and until expressly agreed by Hydrolift and duly signed by the authorized representative giving in writing.
Hydrolift is governed by its Code of Conduct and all customers dealing with Hydrolift or its representatives shall be deemed to be bound by the provisions stated in the Code of Conduct.
Hydrolift reserves the rights to all intellectual and industrial property rights, copyright of samples, cost estimates, drawings, and similar information of a tangible or intangible kind, including such information in an electronic form, printed form; third parties shall not alter, misuse and indemnify Hydrolift for all consequential damages arising out of such abuse.
